Steps Of Our Process

Consumer Assistance Law will evaluate your individual situation with your mortgage. Whether you are current or facing a sale date our process may be effective in assisting you. Once you have retained our services we will initiate a telephonic client interview which will provide our legal team valuable information for us to begin our course of action for your individual situation. During this time you will be required to provide specific personal and financial information as well as any documents regarding any pending litigation relating to your mortgage for the purpose of preparing and presenting a pre trial settlement offer and establishing any defenses or actions available against your lender. We use multiple Federal and State laws to defend or bring action against your lender. We use these laws along with a loan and audit securitization analysis to gain leverage in order to obtain a favorable settlement and to aggressively defend or bring any action against your lender. The securitization analysis is one of the most powerful tools we use in successfully bringing or defending an action against your lender. A securitization analysis is the process we use to gather information and leverage by uncovering issues with your mortgage that started at inception of your loan and who may presently own your note and all activity in between. This is done and given to you as part of retaining our services. Your loan may be part of an endless flow of missing documents and discrepancies that can be uncovered using the securitization analysis and loan audit.

Attorneys may also be able to challenge the right of a plaintiff to sue based on the fact that they could not prove that the plaintiff/lender actually owned the mortgage. This could stall the case indefinitely or at least until they can trace back from all the servicer transfers and the sale of the mortgage from one investor to the other in order to find the original signed document that says that you, the borrower, actually owe the money. In some cases that document does not exist. There have been federal judges that have totally eliminated the mortgage balances because they couldn’t prove that the defendant actually owed that amount of money!

Finally, there are thousands of state and federal rules that a lender must abide by as they lend money. There are so many that it’s nearly impossible to faithfully fulfill all the necessary requirements. It may be a wise idea to have an attorney audit your loan documents and possibly bring law suits against lenders. Your debt could be erased in its entirety but most likely your attorney could at least delay a judicial or even a non judicial foreclosure and very often lower the balance of the loan to a significant amount that your lender will be motivated to be more aggressive about offering you a reasonable short sale settlement or even better option to keep your house.
